00:40:05Thank you so much, Chief Whip. Thank you so much. We move on to the speakers. Where's the hand? Councillor Simonse.
00:40:25Thank you, Madam Speaker. The Patriotic Alliance is asking for 30 minute caucus, please.
00:40:32I I I want to ask and I do not deny anybody from their rights. But, I also need to understand when we ask for caucus do we not all do what we have to do within that time? And we are even late now.
00:41:01Colleagues, it can't be. It honestly can't be. We have one item. We need to deal with the one item. Some of us still need to go and deal with the procedures of tomorrow. So, I am not going to grant you 30 minutes. I'm going to grant you 15 minutes and 15 minutes sharp.
00:41:23Okay, Madam Speaker. Then, we withdraw our caucus. Thank you.
ACDP opposes the KfW loan
00:41:27Thank you so much, ma'am. It's appreciated, but I really, honestly think that if we go for a caucus, let us all use that time. Thank you so much. Can we move to Councillor C, eh, to Councillor R. Harris.
00:41:47Good morning, Madam Speaker, once again, Executive Mayor, MMCs, CM, all officials
00:41:54Councillor Harris, just hold on. Can I ask for less movement? Thank you, Councillor Harris.
00:42:04Madam Speaker, I rise to speak to the request to enter into a loan agreement. Uh, City Power is in crisis. The R4.6 billion allocated to capital projects over 3 years. The Infrastructure Development Grant is a relevant, uh, relative pittance that they receive. The overdraft on the sweeping account is over R16 billion and growing. The entity has to service the nearly 80,000 people streaming into Johannesburg annually. The debt owed to Eskom is R5.2 billion. We are at the end of a 5-year tenure now. This council is being asked to commit to a loan where a portion will attract interest of R616 million. This equates to 30 biannual payments of R44 million. To put this into perspective, the annual maintenance budget for council-owned housing stock is half that amount. In addition, R17.5 million is a once-off upfront cost for entering into this agreement.claim
00:43:11There's no investment in underserviced areas. Resource allocation is questionable. There seems to be no input from the Presidential Working Group and the bomb squad to pressurize national and provincial treasuries to support the city financially. Public-private partnerships that could assist the city financially are trapped in a bureaucratic maze. Instead, hundreds of million are hundreds of millions are given to formalise informal settlements. We at the end of the council's tenure, as the ACDP, we feel it is unfair to commit the next council and the next generations to an agreement that is questionable. We will not be supporting this item. Thank you.claim

00:46:36Madam Speaker, you know, there's no reason why we should be debating this item. Because this item was brought into this house, and this council approved this item. So, today, we couldn't be saying when we agreed that it should be it should form part of our funding model, that we say today we do not want it. That we say today we will be committing the the next council. Uh as a result, Madam Speaker, I'm saying, Ka Bo Yellow to this item.
00:47:24Thank you.

DA supports the loan after amendments
00:49:58Councillor Santana from the Democratic Alliance.
00:50:04Madam Speaker, Executive Mayor, Deputy Executive Mayor. Mortgaging the future through debt today is not a decision that should ever be taken lightly. An 18-year-old scholar perhaps sitting in Matric today, or one of the many unemployed young people who had no seat in this council chamber and no voice in these deliberations will likely be in their 40s by the time this loan is finally paid or repaid. That is the long-term burden we are placing on the next generation. The uncomfortable truth is it's easy to take on debt, but it's far more difficult to exercise financial discipline. Real financial stewardship requires planning, saving, prioritizing needs over wants, and remaining committed to long-term sustainability. The same principles apply to households, apply equally to government.
00:50:56A city that has continued borrowing borrows funds to uh to fund its obligations risks trapping residents in a cycle where tomorrow's opportunities are sacrificed to pay for today's failures. Madam Speaker, unfortunately, we find ourselves between a rock and a hard place. City Power has become and continues to be a significant drain on the city's financial resources. Yet, residents rightly demand infrastructure that is reliable, maintained, and capable of supporting economic growth and daily life. It is precisely for this reason that good governance, accountability, and oversight are essential. The Democratic Alliance
00:51:38raised several serious concerns regarding both the report and the conditions attached to the to the loan. Among the concerns raised were the following: The conditions of the loan and the council report did not adequately align with each other or one another. The report described the intent, the intended use too broadly as City Power electrical infrastructure without significant or sufficient project-specific detail. The allocation of the project coordinator and the German government monitoring mechanisms were not properly reflected in the recommendations.
00:52:13The report did not provide sufficient safeguards to prevent the loan from later being redirected towards operational expenditure under the broad description of City Power electrical infrastructure. The freezing of the executive salary increases and performance-related adjustments at City Power for the duration of the loan period was not clearly articulated despite the severe financial pressures facing the city. The recommendations are not expressly state that the loan would be redirected exclusively to the listed projects nor were the projects fully incorporated into the report itself.
00:52:48These concerns demonstrate demonstrate that the Democratic Alliance commitment to good governance and to ensuring that the councillors are provided with sufficient, transparent, and credible information to make informed decisions that carry long-term financial implications. Madam Speaker, we therefore welcome the inclusion of the amendments requested by the Democratic Alliance together with additional nine annexures and amendments made to both the report and recommendations which will now provide significantly greater detail and clarify or clarity regarding the conditions and governance framework attached to this loan.
00:53:24These annexures include the Annexure 1, the results matrix; Annexure 2, which is a project list; Annexure 3, total cost of financing; Annexure 4, the disbursement procedure; Annexure 5, the procurement guidelines; Annexure 6, the environmental and social commitment plan; Annexure 7, declaration of undertaking; Annexure 8, which is most important, the terms of reference for annual audit and procurement and fund verification; Annexure 9, the content and form of reporting to KfW.
00:53:57We further welcome the amendment recommendations following the deliberations which now include: Council notes and approves the conditions attached to the loan as outlined in Annexures 1 to 9. Council notes and that the project coordinator and the German government will monitor the implementation of the projects. Council approves the freezing of executive salary increases and performance-related adjustments at City Power, the state-owned company limited for a minimum period of 2 years and Council notes that the loan will only fund projects specifically listed in Annexure 2.
00:54:34As a Democratic Alliance, it is important that this council fully appreciates the strict conditions attached to this loan together with the updated and gazetted National Treasury regulations, which place increasing responsibility and accountability on public representatives for financial decisions taken in the chamber. Madam Speaker, the loan amount and the key, uh key terms are as follows: The total loan of 200 million euro, estimated to approximately 3.8 billion. The loan tenure is 15 years at a fixed interest rate up to 9% amortized through semi-annual repayments. The disbursements occur annually aligned to City Power's approved capital budget program, which is uh listed in Annexure 2. The expected drawdowns for 2025/26, approximately 732.7 million, with the balance will be drawn down in the subsequent financial years. Uh we are aware of there's no security required and the front-end on-cost, uh the front-end fee of 0.5% estimated at approximately 19 million. An indicative total cost of the loan of the 15 years is approximately 1.349 billion.claim
00:55:40Madam Speaker, while we remain deeply concerned about the city's financial position and the long-term risk associated with debt, we also recognize the urgent need to stabilize and and modernize critical electricity infrastructure. Based on the additional conditions, amendments, annexures, and oversight mechanisms now included, the Democratic Alliance will support the loan. I thank you.claim

00:56:01Thank you, Councillor Santana. EFF Councillor Zitha.
00:56:08Thank you very much, Speaker. 00:57:33Madam Speaker, let me congratulate the only team that has made history, winning the league, winning the game without even lifting a finger.emotive
00:57:49isiZuluEzikaMagebhula ezagebhula umhlaba kaMasipala ngenkani.
00:57:55We are groundbreakers. Let me first acknowledge and commemorate a significant day on the African continent's calendar, Africa Day. This day must never become a symbolic celebration disconnected from the realities confronting African people. Africa Day reminds us that liberation was never only about political freedom. It was also about restoring African dignity, identity, memory, and African humanity. That is why the signing of the African Indigenous Spirituality Charter under the stewardship of African Association for Indigenous Spirituality and African Hidden Voices this past Saturday was both significant and necessary. The charter is not about division or attacking anyone's beliefs. It seeks to affirm and protect African indigenous knowledge systems, spirituality, customs, and heritage that were historically marginalized and erased through colonialism and imposed systems of domination.claim
00:58:49Let me acknowledge the contribution of Dr. Nokuzola Mndende, whose work continues to contribute meaningfully to conversations around African indigenous spirituality, African restoration, and the importance of preserving African systems of knowledge and identity in a democratic society. Importantly, this charter stands firmly with the values of our constitutional democracy. The Constitution of South Africa protects freedom of belief, conscience, culture, language, and the rights of communities to practice and preserve their tradition with dignity. The charter is also aligned with international instruments such as the United Nations Declaration on the Rights of Indigenous Peoples and the African Charter on Human and Peoples' Rights, both which recognize the importance of protecting indigenous identity, heritage, and cultural systems. Madam Speaker, Africa cannot rise while disconnected from itself. African restoration cannot only be economic and political. It must also involve restoring confidence in African civilization, African knowledge systems, and African humanity. Africa Day must therefore become more than a celebration. It must become a commitment to African renewal. We do note and support the
01:00:00the item. Thank you.
ANC supports the loan
01:00:02Thank you, Councillor Zigebe. Councillor Radebe, Radebe from the ANC.
01:00:09isiZuluThank you, Madam Speaker. Ngibingelele uMeya wethu uKhansela uDada Morero, Deputy Executive Mayor, uKhansela uLoyiso Masuku, members of the Mayoral Committee, chairpersons bamakomidi eSection 79. Sibingelele uSotswebhu wethu
01:00:31isiZuluKhansela Khazamula Chauke. Sibingelele uChair of Chairs. Sibingelele wonke amakhansela akhona nabahlali baseGoli eJohannesburg. Madam Speaker siwumbutho kaKhongolose abantwana bakaTambo njengoba sasishilo nasevikini elidlulile ukuthi siyayisapotha impela le-loan. We believe ukuthi isemqoka kakhulu for future generations.
01:00:59isiZuluIt is what we need to lay i-foundation ne-infrastructure esiyidinga kakhulu yogesi. Sibonge nakozakwethu abahlalile bahlaziya babona ukuthi kusemqoka ukuthi bayisapothe nabo le-loan namhlanje njengoba esebekile uKhansela Santana. Sibonge kubo bonke ababonayo ukuthi
01:01:22isiZulufor thina ukuthi siqhubeke siwukhulise umkhandlu waseJohannesburg kuzomele ukuthi sithathe izinqumo namhlanje ezosibhenefitha kusasa. In those words, Madam Speaker, as the African National Congress we approve the loan. Thank you.
MMC Masuku responds to the debate
01:01:36Thank you so much, Councillor. MMC Masuku.
01:01:42Thank you, Madam Speaker. Good morning to you, Ma'am. The Executive Mayor Councillor Dada Morero, the Whip of Council Councillor Khazamula Chauke, Chair of Chairs, fellow MMCs as well as fellow councillors and leaders of all parties, thank you to Councillor Mkhize, Councillor Mhlongo, Councillor Magwentshu, Councillor Ponsonby
01:02:10for and Councillor Radebe for all your remarks which you indicated are not different from your previous inputs. I think, Madam Speaker, through you, Councillor Harris, if indeed, because he speaks about the service and everything that we have to do which will benefit the people, this loan is about benefiting the people.
01:02:37This loan is about ensuring that we secure funding to and it's clear, Councillor Santana, where you are correct. It's clear that it's ring-fenced purely for City Power. It would be treasonous for any government or administration to utilize or try to divert the funds and utilize them for any other thing
01:03:06instead of what KFW has committed to because then it means you would be going against the conditions of the loan as you rightfully put it, Councillor Santana, in the annexures, Annexure 8 and Annexure 2. It's very clear that this is a concessional loan, and it's clear what it must be used for and specifies what has to be utilized for. It's an affordable loan as we indicated earlier, and I think the German Bank is saying let's work. That's why they're putting their weight behind this and
01:03:40for me I think we appreciate caucuses that are actually wanting to make sure Joburg succeeds. Joburg moves forward. This is the kind of a spirit that we should do for the benefit of the residents of Johannesburg. This is the kind of spirit that we should exercise because the Mayor said in the State of the City we are laying a foundation. Now, this foundation is not about you and me.
01:04:08You are correct. It will take 15 years. It might be more. It is for our grandchildren. It is for our great-grandchildren to inherit a city that has got has been able to stabilize through decisions that we make today. And the decisions that we make today are decisions that secure the future to save and make sure that we retain Johannesburg in its rightful place of being a world-class African city.
01:04:38So, thank you to all the councillors who are actually indeed voting for this loan for progress. It's unfortunate, Madam Speaker, that the erstwhile Mayor of the I don't know they are calling themselves the hit squad or what under Herman Mashaba, they are saying to their residents we don't want infrastructure for you. They are saying to the residents of Joburg we don't want lights on for you. ActionSA is voting against service delivery.emotive
01:05:08ActionSA is voting against progress for Johannesburg. We thank all the caucuses that have supported and we ask you support this loan. And when you know that you know what you need to know, what you need to know is for parties that vote for progress and the ANC-led Government of Local Unity is one of those. Thank you, Madam Speaker.emotive
Vote on the KfW loan
01:05:29Thank you so much, MMC. JRA at work. MMC MMC, I know you're at work. Thank you so much.
01:05:56Colleagues, thank you. The recommendations are on pages 1.4 to 1.5. Is the item agreed to? I have I clearly heard the yeses. But for certain reasons we have to go out to voting. We have to vote for this item.
